Wrong arm of the law

Q I Have been caught and fined for speeding offences on two occasions. I paid up - and as a result now have six points on my licence. In both cases the notice I received from the police was dated 14 days after the date of the alleged offences. Do I have the right to contact the police and ask that, as they acted illegally, I want these six points removed from my licence? And are there any particular acts or by-laws I should quote to back up my request? - Jessie Wallace, by email

A it is notoriously hard to re-open or appeal cases after a guilty plea. In your case it sounds as though you accepted a fixed penalty offer, which makes things even trickier. This is because the fixed-penalty procedure is not classed as court proceedings, so you do not have a court to appeal to. You should write to the police and refer to the 14-day time limit - quote section 1(1)(c) of the Road Traffic Offenders Act 1988, which provides the time limit.
